JOHN LOYD SENIOR

In the name of the Benevolent Father of all, I, John Loyd Senior, of Jefferson County and State of Ohio do make and publish this my last will and testament.

Item 1st. It is my will and I hereby devise that my son John Loyd is to have the farm on which I now reside as reference to a deed bearing even date with this instrument will more fully show and on the following conditions.

1st that my son John pay to my eldest daughter Nancy Parrish eight hundred dollars payable in six years after my decease without interest but sooner providing he can pay it.

2nd that my son John pay my second daughter Catherine Joky (transcriber’s note: I am not sure of this name – it could be Joks, Jones, even Yocum) the sum of eight hundred dollars in six years after my decease without interest but sooner in the event he is able.

3rd that my son shall pay to my third daughter Elizabeth Priest the sum of eight hundred dollars in six years after my decease without interest and sooner in the event he is able to pay.

4th that my son shall pay to my fourth daughter Sarah Parrish the sum of eight hundred dollars in six years after my decease without interest and sooner in the event he is able.

5th that my son shall pay to my fifth daughter Susannah Wilson the sum of eight hundred dollars in six years after my decease without interest but in the event he is able to pay in a shorter time.

6th It is my will that in the event my wife should survive me then my son John Loyd is to have six years after her death to pay the above legatees without interest.

7th I hereby direct that after my decease and the decease of my wife that my Executor shall sell at public sale all of my personal estate and divide the proceeds equally between my six heir share and share alike.

8th I do hereby nominate and appoint my son John Loyd Executor of this my last will and testament hereby authorizing and empowering him to compromise adjust release and discharge in such manner as he may deem proper the debts and claims due me, and pay all my debts and funeral expenses out of my personal property. I do hereby revoke all former wills by me made. In Testimony whereof I have hereunto set my hand and seal this 18th day of October in the year 1849.

Testimony
State of Ohio, Jefferson County, Probate Court, June 17, AD 1857

We David McGrew and John Scott having been duly sworn by the Judge of the Probate Court of said County do solemnly swear that we were present at the execution of the last will and testament of John Loyd late of the Township of Cross Creek in said County deceased, which will is now exhibited to us, that we saw the said testator subscribe said will and heard him acknowledge, publish and declare the same to be his last will and testament and that he the said testator at the time of executing the same, was of full age, of sound mind and memory and not under any restraint and that we attested and subscribed the same in his presence and in the presence of each other.

In the matter of the last will and testament of John Loyd, decd.

The last will and testament of John Loyd late of the township of Cross Creek in said county of Jefferson deceased was this day produced in Court and offered for probate and David McGrew and John Scott the subscribing witnesses thereto, appeared and were examined in open court and on oath testified to the due execution of said will which testimony was reduced to writing and filed with said will was duly attested and executed, and that the said testator at the time of executing the same was of full age and of sound mind and memory and not under any restraint, it is ordered by the Court that said will be admitted to probate, and that said will testimony and probate be recorded. Whereupon John Loyd the Executor in said will named appeared in Court and signified his acceptance of the trust of executing said will. It is therefore ordered that Letters Testamentary be issued him on his giving bond in the sum of nine thousand dollars conditioned according to law with John Scott and David McGrew as sureties and that James Thompson, John Scott and John Hammond be appointed appraisers of the personal estate of said Testator.

Whereupon the said John Loyd appeared and gave bond accordingly.
